You also agree not to:

5. Intellectual Property

You agree to indemnify, defend, and hold harmless FOXTOX and its affiliates, officers, directors, employees, and agents from and against all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorney's fees) arising out of or related to your breach of these Terms or your use of the Products.

8. Shipping and Returns

FOXTOX aims to provide reliable shipping services. However, shipping times may vary and are not guaranteed.

Returns and Refunds: Due to the personal nature of skincare products, we cannot accept returns of opened or used Products. Unopened, sealed items may be returned within 14 days of receipt, subject to our inspection. Customers are responsible for return shipping costs unless otherwise specified.

9. Product Availability

All Products are subject to availability. We reserve the right to discontinue or modify any Product without prior notice. We are not liable for any product unavailability.

Waiver & Release of Liability

By purchasing or using any FOXTOX Product ("Product"), you ("User") acknowledge and agree to the following:

  1. Assumption of Risk:
    I understand that the use of skincare products containing active agents such as exfoliating acids and other potent compounds carries the risk of skin irritation, sensitivity, allergic reaction, or other unforeseen reactions. I voluntarily accept and assume all risks associated with the use of FOXTOX Products.

  2. Medical Consultation Advised:
    I affirm that I have been advised to consult a qualified healthcare professional prior to using FOXTOX Products, especially if I have any medical conditions, skin disorders, or concerns about potential interactions.

  3. No Guarantees:
    I understand that individual results will vary and that FOXTOX makes no warranties, express or implied, regarding the performance, effectiveness, or suitability of its Products for any particular user.

  4. Release of Liability:
    To the fullest extent permitted by law, I release, waive, discharge, and hold harmless FOXTOX, its owners, officers, employees, agents, distributors, and affiliates from any and all claims, damages, injuries, causes of action, or losses (whether known or unknown) arising from or relating to the use of FOXTOX Products.

  5. Agreement to Terms:
    By purchasing or using FOXTOX Products, I certify that I have read, understood, and agreed to this Waiver and Release of Liability, and that I am doing so voluntarily.
